Service Terms And Conditions For Crystal Palace Waste Collection

These Terms and Conditions set out the basis on which we provide waste collection services in and around Crystal Palace. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking, as they form the entire agreement between you and us for the provision of our waste removal and related services.

1. Definitions

In these Terms and Conditions, unless the context requires otherwise, the following expressions have the following meanings:

Customer means the person, business or organisation requesting and receiving waste collection services from us.

Services means any waste clearance, rubbish removal, bulky waste collection, household or commercial waste collection, recycling or related services that we agree to provide.

Waste means any items, materials or substances presented by the Customer for removal as part of the Services, including household, commercial, garden or bulky waste, subject to the exclusions set out in these Terms and Conditions.

Contract means the agreement between you and us for the provision of Services, comprising these Terms and Conditions and the information confirmed in your booking.

2. Scope Of Services

We provide waste collection and removal services to domestic and commercial customers, primarily serving Crystal Palace and nearby areas. The type and scope of the Services will be as described in your booking confirmation, which may include one-off clearances or scheduled collections.

We reserve the right to refuse to collect certain items or types of Waste at our sole discretion, particularly where it would be unsafe, unlawful, or beyond the scope of the Services agreed. Examples include hazardous waste, clinical waste, asbestos, gas cylinders, chemicals, or any items that may pose a health, safety or environmental risk.

3. Booking Process

You may request a booking by contacting us through our designated booking channels, such as telephone or online enquiry forms. To make a booking, you must provide accurate and complete information, including your name, contact details, collection address, access details, description and approximate volume or weight of the Waste, and any special requirements.

Based on the information you provide, we will give an estimate or quote for the Services. This estimate may be given verbally or in writing. Your booking will only be confirmed once we have accepted it and communicated confirmation, which may be by email, text message or other written communication. The Contract comes into existence at the point of our confirmation.

You are responsible for ensuring that all information supplied during the booking process is accurate and up to date. If the information you provide is incomplete or inaccurate, we may amend the quoted price, alter the scope of the Services, or, in some cases, cancel the booking. Any material differences between the Waste described and the Waste presented on arrival may affect the price or feasibility of the collection.

4. Access And Customer Responsibilities

You agree to provide us with safe, reasonable and lawful access to the collection address at the agreed date and time. This includes ensuring that entryways, stairwells, lifts, driveways and paths are accessible, clear and suitable for use by our staff and vehicles.

You must ensure that you have full authority to arrange removal of the Waste from the collection address. By presenting items for collection, you confirm that you are the owner of those items or have full permission from the owner to dispose of them.

You must segregate or identify any waste that may require special handling and promptly notify us of any risks, such as sharp objects or heavy items. We may refuse to remove any item that we reasonably believe to be unsafe to lift or transport.

If we are delayed or unable to complete the collection because access is not available, the Waste is not ready, or the information provided was materially incorrect, we may charge a wasted journey fee or additional waiting time fees as reasonably required.

5. Pricing And Payment

Our prices are generally based on a combination of volume, weight, type of Waste, labour time, and access conditions. We may provide an estimate based on your description and confirm the final price on arrival once we have inspected the Waste and assessed the work required.

All prices quoted are exclusive of any applicable taxes unless expressly stated otherwise. Any applicable taxes, levies or charges imposed by law will be added to the price of the Services.

Payment is due in full upon completion of the collection, unless otherwise agreed in writing prior to the Service. We accept payment by the methods notified to you at the time of booking or collection, which may include card payments, bank transfer or cash, subject to our current policy.

For business customers with agreed credit terms, payment must be made by the due date stated on the invoice. If payment is not received by the due date, we reserve the right to charge interest on the overdue amount at the statutory rate, together with reasonable costs of debt recovery.

6. Cancellations And Amendments

You may cancel or amend your booking by contacting us as soon as possible. Where you cancel or substantially amend your booking with more than 24 hours notice before the scheduled collection time, no cancellation charge will normally apply.

If you cancel or materially amend your booking within 24 hours of the scheduled collection time, we may charge a cancellation fee to cover the costs of scheduling and allocating resources. If our team arrives at the property and the collection cannot proceed due to circumstances within your control, we may charge a wasted journey fee.

We will use reasonable endeavours to accommodate changes to your booking, such as changes to time, date, address or volume of Waste. However, we are not obliged to accept amendments, and they will be subject to availability and may result in a revised quote.

We may cancel or reschedule your booking without liability if we are unable to perform the Services due to events beyond our reasonable control, including but not limited to severe weather, vehicle breakdowns, staff illness, accidents, road closures, or legal restrictions. In such cases, we will aim to offer an alternative date or time as soon as reasonably practicable.

7. Service Delivery And Performance

We will use reasonable care and skill in performing the Services and will make reasonable efforts to attend at the agreed time. However, any arrival times provided are estimates only and are not guaranteed. Traffic conditions, operational delays, or unforeseen factors may affect our arrival time.

Upon arrival, our team will inspect the Waste and confirm whether the Service can be carried out at the agreed price. If there are significant discrepancies from the description provided at booking, we may propose a revised price. If you do not accept the revised price, we may cancel the Service, and a call-out fee may apply.

Once the Waste has been loaded onto our vehicle and payment has been received or agreed in accordance with our credit terms, legal title to the Waste transfers to us or to our appointed waste management partners.

8. Waste Regulations And Disposal

We operate in accordance with applicable UK waste legislation, including regulations relating to the carriage, transfer, and disposal of controlled waste. We or our authorised partners will dispose of or recycle Waste at appropriately licensed facilities as far as reasonably practicable.

We may issue a waste transfer note or similar documentation where legally required, and you agree to provide any necessary information requested to complete such documentation. Business customers may be required to retain waste transfer records as required by law.

We will take reasonable steps to maximise recycling and recovery of materials where options are available, but we cannot guarantee that any particular item or percentage of Waste will be recycled. The specific disposal route will depend on the nature of the Waste, site facilities, and regulatory requirements.

You must not present for collection any waste classed as hazardous or special waste unless we have expressly agreed in writing to handle such waste under separate terms and with correct documentation, permits and pricing.

9. Liability And Limitations

We will take reasonable care when carrying out the Services at your property. However, we will not be liable for any pre-existing damage or for damage resulting from inherent defects in the property or items removed, or from poor access conditions that you have not rectified or disclosed.

If our staff cause damage to your property through negligence, you must notify us in writing as soon as reasonably practicable, and in any event within seven days of the collection. We reserve the right to inspect the damage and, at our option, arrange repair, replacement or fair compensation, subject to our overall liability limits.

Our total liability to you for any loss or damage arising out of or in connection with the Services, whether in contract, tort, negligence or otherwise, shall be limited to the total price paid or payable by you under the Contract, or any lower amount required by law, except in respect of death or personal injury caused by our negligence, fraud, or any other liability that cannot lawfully be excluded or limited.

We will not be liable for indirect or consequential losses, including but not limited to loss of profit, loss of business, loss of anticipated savings, or loss of or damage to goodwill.

10. Customer Property And Items Not Intended For Disposal

You must take care to ensure that no items intended to be kept are mixed with the Waste presented for collection. Our staff may ask you to confirm which items are to be removed. Once an item has been loaded onto our vehicle, it may not be possible to retrieve it.

We accept no responsibility for any items that you later claim were removed in error if they were not clearly identified and separated before the collection. It is your responsibility to check the area and confirm that only unwanted items are left for removal.

11. Health And Safety

Our staff are required to follow relevant health and safety procedures when carrying out waste collections. If, in our reasonable opinion, a task cannot be done safely, we may decline to carry it out or may adapt the method of work.

You must not request our staff to undertake any activity that is unsafe, unlawful, or beyond the scope of the Services. You must also keep children, pets and other occupants at a safe distance while waste is being removed.

12. Data Protection And Privacy

We will collect and use your personal data only to the extent necessary to manage bookings, provide the Services, process payments, handle enquiries or complaints, and comply with legal obligations. We will take reasonable steps to keep your personal information secure and will not sell your data to third parties.

Your details may be shared with our staff, subcontractors, and service providers strictly for the purpose of fulfilling the Contract and supporting our business operations, such as payment processing and waste management. We will retain your information for as long as reasonably necessary in line with legal and operational requirements.

13. Complaints And Disputes

If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing your name, address, contact details, booking reference and a clear description of the issue. We will investigate and aim to respond promptly with our findings and any proposed resolution.

We encourage you to raise concerns directly with us in the first instance so that we can seek to resolve matters informally and efficiently. This complaints process does not affect your statutory rights.

14. Changes To These Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in the law, our services, or business practices. Any updated terms will apply to new bookings made after the date of publication. The version applicable to your Contract is the version in force at the time you made your booking.

15. Governing Law And Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

16. General Provisions

If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

No waiver by us of any breach of these Terms and Conditions shall be considered a waiver of any subsequent breach of the same or any other provision. A person who is not a party to the Contract shall have no rights to enforce any term of it.

The Contract is personal to you, and you may not assign or transfer your rights or obligations without our prior written consent. We may assign or subcontract our rights and obligations under the Contract where reasonably necessary to provide the Services.

By confirming a booking with us for waste collection services in Crystal Palace or the surrounding area, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
